Skilled Migration Occupation Lists - More Changes Coming

More changes flagged to Skilled Migration Occupation Lists

Australia’s employer-sponsored, points-tested and state nominated visa programs are now underpinned by three occupation lists:

  • The Short Term Skilled Occupation List (STSOL)
  • The Medium and Long Term Strategic Skills List (MLTSSL) and
  • The Regional Occupation List (ROL)

In order to ensure that nominated occupations and their placements on these lists remain responsive to Australia’s labour market requirements inclusion is subject to intensive reviews, regularly conducted by The Department of Jobs and Small Business and presented under a scheduled and consultative six-stage process, which is designed to allow for input from all relative stakeholders.

Suggested changes

Announced in May 2018, the following changes have been proposed for July 1st 2018 and they represent, quite possibly, the most significant changes put forward since April 2017. It is important to note however that they have not yet reached the point of formal recommendation; they are simply a draft, but they do provide an insight as to the government’s future direction.

Submissions will remain open until June 20th so late adjustments remain a possibility.

Consequences of reallocations

Reallocations are considered approximately twice in every year. The removal of an occupation from the Short Term Skilled Occupations List (STSOL) will result in an inability for workers in those fields to fully meet acceptance criteria and in the loss of eligibility for state sponsorship.

Generally, an occupation will only offer a clear pathway to a permanent visa where it appears on the Regional Occupation List (ROL) but exceptions do sometimes apply.

Don’t delay; early professional advice and assistance is the golden key to success

In the complex and constantly changing world of immigration law, nothing is constant and nothing is simple. It really does pay dividends therefore, to obtain professional assistance, skilled practitioners who are specialised in the field, comprehensively trained to recognise the traps and the trends; achieving the finest possible outcomes in the shortest possible time, whilst avoiding so much unnecessary expense.
